{"id":506,"date":"2017-06-29T15:16:11","date_gmt":"2017-06-29T22:16:11","guid":{"rendered":"https:\/\/www.citizenstrade.org\/ctc\/oregon\/?p=506"},"modified":"2018-04-20T12:50:28","modified_gmt":"2018-04-20T19:50:28","slug":"guatemala-cafta-case-clarifies-fighting-nafta-renegotiation","status":"publish","type":"post","link":"https:\/\/www.citizenstrade.org\/ctc\/oregon\/2017\/06\/29\/guatemala-cafta-case-clarifies-fighting-nafta-renegotiation\/","title":{"rendered":"The Guatemala CAFTA case that clarifies what we\u2019re fighting for, in NAFTA renegotiation"},"content":{"rendered":"<p><img loading=\"lazy\" class=\"alignleft size-full wp-image-507\" src=\"https:\/\/www.citizenstrade.org\/ctc\/oregon\/files\/2017\/06\/screengrab-of-map-of-mexico-and-guatemala_result-jpg-only.jpg\" alt=\"\" width=\"286\" height=\"174\" \/><\/p>\n<p>The United States had been in nine years of litigation against the government of Guatemala in the first-ever labor dispute settlement case under the provisions of CAFTA-DR.\u00a0 Guatemala was\u00a0in trouble for failure to enforce its labor laws.\u00a0 The case closed this past Monday when the panel ruled in favor of Guatemala.\u00a0 Why?\u00a0 Not because Guatemala had met some standard of labor protection.\u00a0 It had not.\u00a0 The panel ruled in favor of Guatemala because CAFTA\u2019s labor-protection enforcement mechanism requires that the party bringing the labor grievance <i>prove that such failure was affecting trade<\/i>.\u00a0 This bar proved too high a reach for U.S. litigators \u2014 at least the way the CAFTA system works.<\/p>\n<p>This is a look at a broken (and shamefully long) enforcement process.\u00a0 Labor and human-rights groups took note, and say this is exactly the inadequacy that cannot be repeated in how we move forward with NAFTA.\u00a0 This point is critical to raise at this time, because NAFTA is in renegotiation, and its current labor rules are toothless and part of a side agreement, not the text itself.\u00a0 Here are a couple quotes from labor and human rights interests, making this point.\u00a0 (Sources for this post are <a href=\"https:\/\/insidetrade.com\/daily-news\/unions-lay-out-nafta-labor-chapter-priorities-wake-guatemala-ruling\">here<\/a> and <a href=\"https:\/\/insidetrade.com\/daily-news\/ustr-faults-panel-incorrectly-concluding-guatemala-labor-violations-did-not-affect-trade\">here<\/a>;
