{"id":6176,"date":"2022-02-03T18:26:07","date_gmt":"2022-02-03T23:26:07","guid":{"rendered":"https:\/\/www.citizenstrade.org\/ctc\/?p=6176"},"modified":"2023-03-02T08:21:08","modified_gmt":"2023-03-02T13:21:08","slug":"competes-vastly-superior-to-usica-on-trade","status":"publish","type":"post","link":"https:\/\/www.citizenstrade.org\/ctc\/blog\/2022\/02\/03\/competes-vastly-superior-to-usica-on-trade\/","title":{"rendered":"COMPETES Vastly Superior to USICA on Trade"},"content":{"rendered":"<p>As Congress considers its approach to improving U.S. economic resilience, Citizens Trade Campaign and others are urging policymakers to support the trade title in the House&#8217;s <em>America COMPETES Act of 2022<\/em>, and has \u00a0strong concern over trade provisions added to the<em> U.S. Innovation and Competition Act of 2021 (USICA)<\/em> shortly before it was passed in the Senate.<\/p>\n<div class=\"page\" title=\"Page 1\">\n<div class=\"section\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>While both bills include critical support for domestic microchip production designed to strengthen U.S. innovation and build critical domestic chip production and supply chains, the House of Representatives have taken a more comprehensive approach to promote the worker-centered trade policy that the Biden administration is pursuing.<\/p>\n<\/div>\n<div class=\"page\" title=\"Page 1\">\n<div class=\"section\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>Unfortunately, aspects of the Senate bill would negatively impact the U.S. manufacturing sectors, and increase U.S. over-reliance on imports of critical goods. Many of these damaging trade terms were added at the insistence of a few Senate Republicans, some of whom proceeded to oppose the legislation anyway.<\/p>\n<div class=\"page\" title=\"Page 1\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>The House\u2019s <em>COMPETES Act<\/em> includes a trade title, which among other things, would:<\/p>\n<\/div>\n<\/div>\n<div class=\"section\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<ul>\n<li><strong>Reauthorize and strengthen Trade Adjustment Assistance (TAA) <\/strong>in order to provide improved job retraining benefits and other support to trade-displaced workers in a wider range of professions and communities than past iterations of the TAA program. TAA will terminate after this year if it is not reauthorized and lack of action to date means the program is now operating at half its normal scope and many workers who lose their jobs to trade do not currently qualify for these benefits.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"section\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<ul>\n<li><strong>Reform the Generalized System of Preferences (GSP) program to strengthen worker rights and newly add environmental standards.<\/strong> The strengthened labor eligibility standards would better protect against violence against trade unionists and other labor rights violations; new environmental language and terms on the advancement of women\u2019s economic empowerment were added for the first time; and new language on human rights and anti-corruption was imported from the Africa Growth and Opportunity Act.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"section\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<ul>\n<li><strong>Stop abuse of the \u201cde minimis\u201d loophole that allows forced labor products, dangerous and counterfeit goods and trade-enforcement-cheating imports to evade detection and enter the United States duty-free.<\/strong> This provision fixes serious trade enforcement and consumer safety problems that have arisen after the 2015 decision to raise the value of imports from $200 to $800 that can enter the United States \u201cinformally\u201d without meeting normal Customs rules. The 2015 change generated a tidal wave of such \u201cde minimis\u201d imports with more than two million express air packages of goods ordered online arriving daily under de minimis rules that allow this flood of imports to skirt inspection, taxes and applicable trade enforcement tariffs or seizure. <em>COMPETES<\/em> closes this loophole.<\/li>\n<\/ul>\n<div class=\"page\" title=\"Page 2\">\n<div class=\"section\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<ul>\n<li><strong>Promotes greater supply chain resilience and less U.S. reliance on imports<\/strong> by requiring a government review of how critical supply chains have been offshored, and enabling the U.S. Trade Representative to potentially stop certain harmful forms of offshoring-related investments by U.S. corporations. <em>COMPETES<\/em> also changes the Miscellaneous Tariffs Bill (MTB) process going forward so as to exclude finished products from the regulatory process that can result in unilateral tariff cuts or suspensions. The concept of an MTB is to provide tariff cuts for inputs needed by U.S. manufacturers that are not made domestically and this improvement ensure that the practice of compiling products meets that standard and thus strengthens domestic supply chains mot undermines them with unilateral tariff suspensions on imported finished products that compete with U.S. goods.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<ul>\n<li><strong>Strengthens and updates anti-dumping and\u00a0countervailing duty law\u00a0<\/strong>to ensure robust enforcement against trade charing and better protect American workers and businesses from unfair competition.<\/li>\n<\/ul>\n<p>The trade title in the House bill merits strong support, in contract to segments of the trade title in\u00a0<em>USICA. \u00a0USICA<\/em> contains the following counterproductive terms:<\/p>\n<ul>\n<li><strong>A Big Tech Special 301 process to constrain digital governance and thwart pro-worker, pro-consumer and anti-monopoly efforts<\/strong>. Congressional Democrats have long sought enhanced enforcement of labor rights through the \u201cSpecial 301\u201d process, which tasks the Office of the U.S. Trade Representative (USTR) with monitoring other nations\u2019 practices and sanctioning the worst offenders. Instead, this bill would establish a Special 301 review process for Big Tech, requiring a team at USTR to monitor other nations\u2019 digital governance policies and issue annual reports designating pro-consumer, pro-worker, pro-privacy, and pro-competition policies and proposals as illegal trade barriers. Nations that maintain such policies would be subject to Section 301 investigations and sanctions. Instead of promoting labor rights and consumer protections in the digital sphere, this provision would undermine the best public interest protections around the world.<\/li>\n<\/ul>\n<div class=\"page\" title=\"Page 2\">\n<div class=\"section\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<ul>\n<li><strong>A Miscellaneous Tariffs Bill (MTB) that provides new duty-free access for finished productions (not just for parts and inputs that are unavailable domestically) and extends that policy into the future. \u00a0<\/strong>The MTB included in\u00a0<em>USICA<\/em> provides new, duty-free access to 1,430 goods, including car parts, heaters and air conditioners, microwaves and other appliances, fitness machines, lighting, suitcases, pianos and more. \u00a0It would allow for future such unilateral tariffs reduction on finished goods, which undermines\u00a0<em>USICA<\/em>&#8216;s goal of rebuilding domestic manufacturing.<\/li>\n<\/ul>\n<div class=\"page\" title=\"Page 2\">\n<div class=\"section\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<ul>\n<li><strong>More\u00a0opportunities to evade tariffs on unfairly-traded, subsidized imports. \u00a0<\/strong>This bill would open a new process for importers to petition to exclude goods from the Section 301 tariff policies now in place.<\/li>\n<\/ul>\n<div class=\"page\" title=\"Page 2\">\n<div class=\"section\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<ul>\n<li><strong>Renewal of the Generalized System of Preferences (GSP) without the improved labor rights and other provisions included in the House version of the legislation.<\/strong><\/li>\n<\/ul>\n<div class=\"page\" title=\"Page 3\">\n<div class=\"section\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>Reconciling the two bills will require honest conversations over how Congress can best help workers, consumers, and the environment. \u00a0Any final package should incorporate trade provisions such as those added to the <em>COMPETES<\/em> bill while limiting damaging trade provisions found in <em>USICA<\/em>.<\/p>\n<p><a href=\"https:\/\/www.citizenstrade.org\/ctc\/wp-content\/uploads\/2022\/04\/COMPETES_USICAletter-020222.pdf\">Our letter to Congress on <em>COMPETES<\/em> versus <em>USICA<\/em> is online here.<\/a><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>As Congress considers its approach to improving U.S. economic resilience, Citizens Trade Campaign and others are urging policymakers to support the trade title in the House&#8217;s America COMPETES Act of [&hellip;]<\/p>\n","protected":false},"author":1,"featured_media":5485,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":[],"categories":[1],"tags":[121,109,122],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v18.4.1 -
